Pure HMV respects your right to privacy. This Privacy Policy sets out details of the information that we may collect from you and how we may use that information.

This Privacy Policy should be read alongside, and in addition to, our website terms of use and our Rewards Club Terms and Conditions, which relate to our loyalty card programme.

Please read this Privacy Policy carefully - by using this website (the "Website") or participating in the Pure HMV loyalty card programme, you agree to its terms (including as amended from time to time).

a)     register with the loyalty card programme;

b)    use your loyalty card, in whatever form, when you buy products or services at HMV or other participating retailers (if any) (e.g. in-store, online, by phone) or take part in promotions, competitions, customer surveys and questionnaires;

The information that we may collect from you includes your registration details such as your name, address, telephone, email and mobile contact details, information about the use of your loyalty card and purchases, your credit or debit card details and other information that you give us.

We may also collect details of your computer's internet protocol address, which is automatically collected by our web server.

Finally, we may receive information about you from third parties (such as credit reference agencies) who are legally entitled to disclose that information.

How do we use your information?

By using the Website or participating in the loyalty card programme, you agree that your information may be used by us and by carefully selected third parties chosen by us for any of the following purposes:

a)     to manage and improve the loyalty card programme;

b)    to provide you with a personalised browsing experience when using the Website;

c)     to fulfil any contractual agreements between you and us;

d)    when we have your consent, to send you details (including by post, phone, fax, email or SMS) of other products and services (including those of participating retailers or third parties) which we think may interest you or to conduct market research;

Disclosing your information

We will share your information with HMV Retail Limited and its group companies, and with participating retailers and with service providers to the loyalty card programme and participating retailers who may use your details to help us manage and administer the loyalty card programme.

We use your information only as set out in this Privacy Policy and will not sell, rent or pass your information on to others for marketing purposes without your express consent (see section entitled Marketing and research below).

We may, however, share aggregated data with third parties in order to develop and enhance the loyalty card programme. This is statistical data which will not include information that could identify any individual.

We may also release account information where we believe in good faith that this release is reasonably necessary to comply with the law.

We may also disclose your information to third parties in connection with the sale, transfer or disposal of our business, provided that they continue to use your information substantially in accordance with the terms of this Privacy Policy.

International Transfers

We (or third parties acting on our behalf) may store or process information that we collect about you in countries outside the European Economic Area, which may have lower standards of data protection.

Security of your information

We follow strict technical and organisation security procedures in the storage and disclosure of information, which you have given us. This is to prevent the loss, unauthorised access or unlawful processing of your personal information. We keep your information confidential and store it on a secure server which is password protected and hidden behind a firewall from the outside world.

However, whilst we have used our best efforts to ensure the security of your data, please be aware that we cannot guarantee the security of information transmitted over the Internet.

  • with offers and information about participating retailers' products or services
  • for customer research e.g. to help improve our services

You may indicate your consent to the above when joining the loyalty card programme on our Website by ticking boxes indicating your consent.

  • following the opt-out instructions contained in the communications that we send you, such as clicking on the "unsubscribe" link on any email newsletter that we send to you;
  • changing your marketing preferences when logging into your account online; or

You have the right to contact us by writing to us at the below address in order to find out what information we hold about you (please note that a £10 fee will be payable) or to access, cancel or correct any information that we hold about you.
